Tote Rental Agreement

This Rental Agreement ("Agreement") is between Timely Totes, a moving tote rental business in Clay County, Florida ("Timely Totes", "we", "us"), and the person who places the reservation ("Customer", "you").
You accept this Agreement when you tick the agreement box at checkout, pay for a reservation, or accept delivery.
1. What you are renting
You are renting reusable 27-gallon plastic storage totes with lids, plus any other items listed on your booking confirmation (together, the "Equipment"). The Equipment stays our property at all times.
Your booking confirmation states the number of totes and lids, the rental dates, the delivery area and the price. It forms part of this Agreement.
2. Rental period
The rental period starts on the delivery date and ends on the scheduled pickup date shown in your confirmation. Rentals are sold in one-week blocks of one to four weeks.
Reservations need at least 48 hours' notice and are subject to availability. If we cannot fulfil a reservation, we will offer you a new date or a full refund.
3. Price, sales tax and payment
- Full payment is due when you book. We do not take a deposit.
- Prices are shown before tax. Florida sales tax and the surtax of the delivery county are added as a separate line.
- Charges that arise after booking are invoiced to the email address on your booking. These include extensions, return-trip fees, late fees, cleaning fees and replacement fees.
- Invoices are due within 7 days of the date sent.
- Unpaid amounts may be referred for collection as permitted by Florida law.
4. Delivery and pickup
We serve Clay, Duval, St. Johns, Nassau and Baker counties in Florida. Delivery charges depend on the one-way driving distance from our base in Middleburg, Clay County, as measured by Google Maps. Addresses more than 50 miles away are served only by arrangement, at a delivery charge we quote before you book.

- We deliver and pick up within the window shown in your confirmation. Arrival times are estimates.
- We deliver to the main entrance, garage or doorstep. We do not carry Equipment inside or up stairs unless we agree to this in advance.
- You authorise contact-free delivery. If nobody is present, we will leave the Equipment at the delivery address in the place described in your booking notes.
- We photograph the Equipment when we leave it. Delivery is complete at that point.
- You must give us safe, legal and reasonable access. That includes gate codes, a place to park and secured pets.
- At pickup, every tote must be empty and stacked with its lid in one accessible place by the start of the pickup window.
- If we cannot complete a delivery or pickup because of no access, unsafe conditions, or totes that are not empty and ready, a $25 return-trip fee applies for each extra visit.
5. Extensions and late returns
- Ask for an extension before your scheduled pickup date. Extensions depend on availability.
- An approved extension costs $15 for each additional week and is charged before the extension begins.
- If the Equipment is not ready at the scheduled pickup and no extension was approved, a late fee of $15 per week, or any part of a week, applies until we collect it. Any return-trip fee is added.
- Equipment not returned within 14 days after the scheduled pickup date, with no arrangement agreed with us, is treated as lost. The replacement fees in Section 7 then apply in addition to late fees already owed.
6. Your responsibilities
You are responsible for the Equipment from delivery until we pick it up. This includes loss, theft and damage caused by movers or anyone else.
You agree to:
- Use the Equipment only for lawful packing, moving and storage of household or office goods.
- Take reasonable care of it and keep it indoors or under cover. Totes are not waterproof, airtight or pest-proof.
- Avoid overloading. We recommend no more than 50 pounds per tote.
- Keep the Equipment within our service area unless we agree otherwise in writing.
You agree not to:
- Put in hazardous, flammable or corrosive materials, fuel, paint, chemicals, ammunition, explosives, perishable food, unsealed liquids, live animals or anything illegal.
- Paint, drill, cut or permanently mark the Equipment, or apply adhesive labels that leave residue.
- Sell, lend, sublet or give the Equipment to anyone else.
7. Loss, damage and cleaning
Normal wear is expected and is not charged. Normal wear means scuffs and light scratches from ordinary moving use.

- Damage includes cracks, broken handles, warping, burns, permanent markings, lasting odours and contamination.
- A tote that cannot be made usable is charged as destroyed.
- We record the count and condition of the Equipment with photographs at delivery and at pickup. Those records are used to decide any charge.
- Tell us within 24 hours of delivery if the count or condition differs from your confirmation.
- We will email you the photographs before we invoice a damage, cleaning or replacement charge.
8. Cancellations, changes and refunds

- You may reschedule once at no charge with at least 24 hours' notice, subject to availability.
- Refunds go back to the original payment method.
- If we cancel, you receive a full refund.
9. Weather and events outside our control
We are not liable for delays caused by weather, traffic, vehicle breakdown, illness or other events beyond our reasonable control.
If a tropical storm or hurricane watch or warning, an evacuation order, or a declared state of emergency covers the delivery or pickup address, we may reschedule. No late fees build up for days on which we cannot safely pick up. You remain responsible for taking reasonable care of the Equipment, including bringing it indoors.
10. Limits on our responsibility
- The Equipment is provided as is. We clean and inspect it between rentals. To the extent Florida law allows, we make no other warranties, including warranties of merchantability or fitness for a particular purpose.
- We are not responsible for loss of, or damage to, anything you put in the totes. You are responsible for packing, lifting and insuring your belongings.
- Keep valuables, important documents, medication and irreplaceable items with you.
- To the extent Florida law allows, we are not responsible for injuries that result from lifting, carrying, stacking or moving the totes.
- Our total liability under this Agreement is limited to the amount you paid for the rental. We are not liable for indirect or consequential losses.
- Nothing in this Agreement limits liability that cannot be limited under Florida law.
11. Indemnity
You agree to indemnify and hold harmless Timely Totes, its owner and its workers from claims, losses and costs, including reasonable attorneys' fees, that arise from your possession or use of the Equipment, the contents you put in it, or your breach of this Agreement. This does not apply to the extent a loss is caused by our gross negligence or wilful misconduct.
12. Communications
We contact you by email about your rental, including confirmations, delivery and pickup notices, and charges. Please check the email address on your booking during your rental, and tell us if it changes. We send marketing emails only if you opt in separately.
13. Privacy
Our Privacy Policy explains what we collect and why, including delivery and pickup photographs.
14. Electronic agreement
You consent to doing business with us electronically. Ticking the agreement box at checkout is your signature under Florida's Electronic Signature Act. We email you a copy of this Agreement with your confirmation.
15. General terms
- Governing law and venue. Florida law governs this Agreement. Any dispute will be heard in the state courts located in Clay County, Florida.
- Whole agreement. This Agreement, your booking confirmation and our Terms of Service are the whole agreement between us. If they conflict, this Agreement controls for the rental.
- Severability. If a court finds any part unenforceable, the rest stays in effect.
- No waiver. If we choose not to enforce a term once, we may still enforce it later.
- Changes. We may update this Agreement for future rentals. The version in effect when you book governs your rental.
- Age. You confirm that you are at least 18 years old.
Acceptance statement
I have read and agree to the Timely Totes Rental Agreement. I am responsible for all totes and lids from delivery until Timely Totes picks them up. I agree to pay the extension, late, return-trip, cleaning and replacement charges described in it.
